The website located at www.ews-wm.com, including its sub-domains, affiliated websites, mobile versions, and all services available therefrom (collectively, the "Site"), is owned and operated by Ecowaste Services, Inc., a California corporation with its principal offices at 1812 W. Burbank Blvd, #1018, Burbank, CA 91506, also doing business as "Ecowaste," "Ecowaste Solutions," and "EWS" (collectively, "Company," "we," "us," or "our").

1. Changes to the Site or Terms

We reserve the right, at any time and in our sole discretion, to modify, suspend, or discontinue the Site, in whole or in part, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

We also reserve the right to revise these Terms or impose new conditions at any time. Revisions become effective when posted. Your continued access to or use of the Site after posting of revised Terms constitutes your acceptance of those revisions. No modification binds the Company unless expressly agreed to in writing by an authorized officer of Ecowaste Services, Inc.

2. Term and Termination

These Terms remain in effect for as long as you use the Site. We may terminate these Terms or your access to the Site at any time, for any reason, without notice or liability, including if you breach any provision of these Terms. Upon termination, your right to access and use the Site ceases immediately.

The following sections survive any termination of these Terms: Site License; Site Content, Disclaimer of Warranties, User Conduct, Copyright and Trademark, Privacy, Governing Law, Limitation of Liability, Indemnification, and Miscellaneous. All rights you have granted to the Company remain in full force, and the Company may retain or delete your personal data as permitted by applicable law.

3. Site License and Content

License. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for your own personal, non-commercial purposes. Unauthorized access to or use of the Site or its Content is a breach of these Terms and may violate applicable law.

Site Content. Unless expressly permitted, no information, materials, files, videos, or other content ("Content") on the Site may be reproduced or used without our prior written consent. The Site and all Content are the property of Ecowaste Services, Inc., its licensees, or licensors, and are protected by United States and international copyright, trademark, and intellectual property laws. You acknowledge that we retain exclusive ownership of all such rights. You agree not to: copy, modify, distribute, sell, reverse engineer, decompile, or disassemble any part of the Site or its Content; use automated tools (bots, scrapers, spiders) to access or monitor the Site; or remove any copyright or proprietary notices from Content.

4. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, OR COMPLETELY SECURE. YOUR USE OF THE SITE AND RELIANCE ON ANY CONTENT IS ENTIRELY AT YOUR OWN RISK.

Some jurisdictions do not allow exclusion of implied warranties; in such jurisdictions, the Company's liability is limited to the fullest extent permitted by applicable law.

5. User Conduct and Prohibited Activities

• Is defamatory, libelous, harassing, abusive, hateful, obscene, or otherwise objectionable; or
• Contains malware, viruses, or other harmful code.

You also agree not to:

• Access the Site after your access has been terminated;
• Use any automated means to access or scrape the Site or its Content;
• Attempt to gain unauthorized access to any part of the Site or its infrastructure;
• Interfere with or disrupt the Site, its servers, or networks;
• Forge headers or manipulate identifiers to disguise the origin of transmitted content;
• Impose an unreasonably large load on the Site's infrastructure; or
• Engage in any activity that violates applicable law.

The Site may contain links to third-party websites or services ("Third-Party Links"). We do not control, endorse, monitor, or make any representations regarding Third-Party Links. Your use of any Third-Party Link is at your sole risk and subject to that third party's terms and privacy policy. We provide Third-Party Links solely as a convenience and are not responsible for their content, accuracy, or availability.

7. Email Communications

By providing your email address when using the Site or requesting our services, you consent to receive transactional emails related to your orders, account, and service requests. Where you separately opt in, you also consent to receive marketing and promotional communications about our services, offers, and updates.

Opting Out. You may unsubscribe from marketing emails at any time by clicking the "Unsubscribe" link in any marketing email or by contacting us at info@ews-wm.com. Opt-out requests will be honored within ten (10) business days. Even after opting out of marketing emails, you will continue to receive transactional and service-related emails necessary for the fulfillment of your requests.

CAN-SPAM Compliance. We comply with the federal CAN-SPAM Act. Our commercial emails identify themselves as such, include our physical mailing address (1812 W. Burbank Blvd, #1018, Burbank, CA 91506), and provide a clear, functioning opt-out mechanism. We do not use deceptive subject lines or sender information.

We will not sell or transfer your email address to third parties for their own marketing use without your express consent.

8. SMS / Text Message Communications

By providing your mobile telephone number and affirmatively opting in, you expressly consent to receive recurring automated text messages (SMS/MMS) from or on behalf of Ecowaste Services, Inc. for marketing, service notifications, and account updates. Message frequency varies based on your account activity and the services you request.

Rates. Standard message and data rates may apply. Check with your wireless carrier for details. Neither we nor your carrier are liable for delayed or undelivered messages.

Opt-Out. To stop receiving text messages, reply STOP to any message. After opting out you will receive one confirmation message and no further texts unless you opt back in.

No Purchase Required. Your consent to receive text messages is not a condition of purchasing any product or service from us.

TCPA. We comply with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable California law governing electronic communications. By opting in, you represent that you are the account holder or authorized user of the mobile number provided.

Use of any such marks without our prior written consent is strictly prohibited. All other trademarks or service marks referenced on the Site are the property of their respective owners.

12. Privacy

Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference and may be revised as provided therein. If you are a California resident, the Privacy Policy also describes your rights under the California Consumer Privacy Act (CCPA) / California Privacy Rights Act (CPRA). By using the Site, you acknowledge and agree to the data practices described in the Privacy Policy.

13. Legal Notices

We may be required by federal or state law to deliver certain notices to you. These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. You irrevocably consent to the exclusive jurisdiction and venue of the state or federal courts located in Los Angeles County, California for all disputes arising out of or relating to these Terms, the Site, or the Content, and you waive any objections to such jurisdiction or venue, including on the basis of inconvenient forum.

The Site is controlled and operated by us from the United States. You agree not to use the Site in any jurisdiction where its use is restricted or prohibited by local law.

15. Users Outside the United States

If you: (a) are accessing the Site from a country subject to a U.S. government embargo; (b) appear on the U.S. Treasury Department's Specially Designated Nationals list; or (c) appear on the U.S. Commerce Department's Denied Persons or Entity lists, you may not use the Site for commercial activities or in violation of U.S. export control laws. 16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ECOWASTE SERVICES, INC., ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS (COLLECTIVELY, THE "COMPANY PARTIES") BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION — ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE LEGAL THEORY ASSERTED.

IF ANY COMPANY PARTY IS FOUND LIABLE TO YOU NOTWITHSTANDING THE FOREGOING, THAT PARTY'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100 USD).

Some jurisdictions do not permit exclusion or limitation of incidental or consequential damages; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

17. Indemnification

You agree to defend, indemnify, and hold harmless the Company Parties from and against any and all claims, losses, liabilities, damages, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms or any applicable law; (b) your access to or use of the Site or Content; (c) your violation of any third party's intellectual property, privacy, or other rights; (d) any defamatory or tortious conduct by you; or (e) any claims you make against third parties relating to our products or services. We reserve the right, at our expense, to assume exclusive control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense.

18. Miscellaneous

Entire Agreement. These Terms, together with the Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and us regarding the Site and supersede all prior agreements, representations, and understandings.

Waiver. Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and all remaining provisions will continue in full force and effect.

Section Headings. Section headings are for convenience only and have no legal or contractual effect.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
